The Definition and Purpose of At-Will EmploymentThe Definition and Purpose of At-Will EmploymentAt-will employment describes the employment relationship between employers and employees in nearly every state. This type of employment relationship means that the company does not offer tenureor guaranteed employment for any period to any employee without anemployment contract or written direction from the CEO/President. With at-will employment, either the company or the employee can terminate the employment relationship at any time, with or without cause, and with or without notice. Expectations of the Employer At-will employment does not mean that employers can arbitrarily fire employees without good faith communication, fairness, and non-discriminatory practices.Courts are increasingly finding for employees in litigation when the employer tells the employee that he has let him go at-will. Employers must demonstrate a good faith effort to correct the employees performance or the oth er issues that led to employment termination. The employer needs to document the employees performance problems and the efforts that were made to help the employee improve. This documentation is filed in the employees personnel record. If a lawsuit occurs as a result of employment termination, the employer is protected by the documentation that led up to the employment termination. It is especially true if all of the documents are signed by the employee to indicate that she saw the documents. Expectations of the Employee Likewise, the employee has certain obligations to the employer. Among these are to work with reasonable skill and care, carry out legal employer orders and not disclose confidential company information. Experts recommend that an employee gives his employer two weeks notice when he quits. This notice allows the employer and employee to tidyup loose ends. It also gives the employer the opportunity to begin looking for a new employee before the old one leaves, mini mizing the amount of time the position is unfilled. Never Fire an Employee Just Because You Can Because we have at-will employment should never be used as the reason to fire an employee. HR and employment law lawyers advice can differ widely on how much to tell an employee at the termination meeting, but neither HR nor the lawyer would recommend telling the employee that the termination is because the employer can. Its much better to refer to the history of employee performance issues that were documented along the way. Simply tell the employee that because of all of the performance issues discussed in the past, his employment is terminated. Sample Employment At-Will Policy It is a good idea for employers to include an employment-at-will policy in their employee handbooksfor easy reference. The following is a sample which should be customized to your business. The Company does not offer tenureor any other form of guaranteed employment. Either the Company or the employee can terminate the employment relationship at any time, with or without cause, with or without notice. This is called Employment At-Will. This employment at-will relationship exists regardless of any other written statements or policies contained in this Handbook or any other Company documents or any verbal statement to the contrary. Progressive Discipline and Employment At-Will While the Company may elect to follow itsprogressive discipline procedure, the Company is in no way obligated to do so. Using progressive discipline is at the sole discretion of the company in an employment at will workplace. Exceptions to the Employment At-Will Policy No one except The Companys CEO/President can enter into any kind of employment relationship or agreement that is contrary to the previous statement. To be enforceable, such relationship or agreement must be in writing, signed by the CEO/President, and notarized.

How do we know if we are really in the right career? How Do You Feel on Sunday Night?This is a pretty big sign of how muchyou like your job. Do you find yourself growing depressed as Sunday night falls? Does the idea of getting up tomorrow morning leave you feel despondent?If youfeel reenergi zed and ready to go at the beginning of the work week, then your career and current job are probably a good fit for you. If, on the other hand, you look at the coming work with dread, then its time to ask yourself a few questions.2. How Much Effort Do You Put Into Your Work?When there are problems to be solved and challenges to surmount, what do you do? This means that they participate in non-work related activities, both during the work day and outside of work. If you genuinely enjoy your colleagues and look forward to engaging in some fun with them, you are most likely in the right place.9. Do You Think About Work a Lot When Youre Not There?Whether or not this means your job is right for you depends on the kind of thinking you do. If your thinking is negative if you replay conflicts with your boss or colleagues or you think about how unappreciated you are then you need to move on.If, on the other hand, your thinking about work is positive if youre always thinking about solutions to challenges you face or new ideas to help the business succeed then you are probably in a good spot in your career and in your current position.10. Whats Your Gratitude Level?Do you feel grateful to have the career and job that you have? Do you look around at friends and family who complain about their jobs and feel happy that you dont have those kinds of complaints? People who love what they do are grateful for the opportunity to do just that.The answers to these eleven questions should give you some insight into your career and your career goals. There is something wonderful in knowing that you have chosen the right career and that your current position in that career is rewarding for you.There is also something wonderful in realizing that you need to make some changes. Whether that means moving to another organization or changing careers entirely, making changes can bring us to new levels of happiness and fulfillment.
